The “AncestralScotland" Sweepstakes

 

OFFICIAL RULES

 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.

 

1. How to Enter. Log onto www.ancestralscotland.com and follow the directions to enter between 12:01 AM Eastern Time (ET) on July 1, 2008 and 11:59 PM ET on August 31, 2008. You must include on the online entry form your complete name, e-mail address, and zip code. All entrants must have a valid e-mail address. In case of dispute as to identity of entrant, entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc) responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.

 

The potential winner will be required to provide Sponsor (defined below) with proof that such winner is the authorized account holder of the e-mail address associated with the winning entry. Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. Sponsor, its affiliates, partners, agencies and entities involved with the administration or fulfillment of this Sweepstakes are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in the Sweepstakes or downloading any materials in the Sweepstakes.

 

Eligible individuals are entitled to only one entry. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically corrupted or misdirected submission and will not be deemed to be proof of receipt by Sponsor.

 

2. Eligibility. Participation open only to legal residents of the U.S. and Canada. Void in Florida, Puerto Rico, anywhere outisde of the U.S. or Canada and where prohibited, taxed or restricted by law. Employees, officers & directors of VisitScotland, ("Sponsor"), Scottish Ancestral Trail, ScotlandsPeople Centre, Scottish Roots, Graham Brit Services, Macdonald Hotels, Continental and Canadian Affair and their parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers, or distributors of sweepstakes materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. This Sweepstakes is governed exlusively by the laws of the United States and Canada and may only be entered in or from the United States or Canada and entries originating from any other jurisdiction are not eligible for entry.

 

3. Drawing. The winner will be selected in a random drawing from all eligible entries received. Odds of winning depend on the number of eligible entries received for the drawing. Drawing will be conducted by Aptinet, an independent judging organization, on or about September 10, 2008. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Sweepstakes.

 

4. Prizes. One (1) Grand Prize: A trip for two (2) to Scotland, consisting of round-trip coach-class airfare from anywhere in the United States or Canada on Continental Airline or Canadian Affair to Edinburgh or Glasgow, 4-night, 5-day hotel accommodations (double occupancy with dinner and breakfast provided) in Scotland, including 2 nights in Macdonald Holyrood Hotel, Edinburgh & a further 2 nights in another Macdonald Hotel in mainland Scotland (excluding all Scottish islands) to be determined by the region most closely related to the winner's Scottish ancestry. The winner must choose 1 additional traveler, who must be aged 12-years or older, for a total group of 2. Grand Prize includes: 2-meals daily, transfer by chauffeur driven car from airport to hotel and between all hotels and visitor attractions included as part of the trip. Prize must be taken between September 30th, 2008 and December 23rd, 2008, or prize will be forfeited and awarded to an alternate winner in a random drawing from all remaining eligible entries.

 

Prize is valued at $8,000 or $8,163 Canadian.

 

All travel and accommodations are at the winner's and travel companion's risk.

 

5. Notification. Winners will be notified by e-mail and will be required to sign and return, where legal, an Affidavit of Eligilility and Liability/Publicity Release within seven (7) days of prize notification. Travel companions will also be required to sign and return a Liability/Publicity Release, prior to issuance of prize elements. If winner cannot be contacted, if any prize is returned as undeliverable, or in the event of noncompliance with these Sweepstakes rules and requirements, the prize will be forfeited and an alternate winner will be selected. Upon prize forfeiture, no compensation will be given.

 

6. Conditions. All taxes are the sole responsibility of the winner. Participation in Sweepstakes and acceptance of prize constitutes winner's permission for Sponsor to use his/her name, address (city and state), likeness, biographical information and any statements made by winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrants, winner and travel companions agree to release and hold harmless VisitScotland, ("Sponsor"), Scottish Ancestral Trail, ScotlandsPeople Centre, Scottish Roots, Graham Brit Services, Macdonald Hotels, Continental and Canadian Affair, their respective advertising and promotion agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successsors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitations, property damages, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if any prize cannot by awarded due to travel cancellations, delays or interruptions due to Acts of God, Acts of War, natural disasters, weather or terrorism. Entrants who do not comply with these Official Rules, attempt to interfere with this Sweepstakes in any way shall be disqualified. Prizes are non-transferable. No substitutions or cash redemptions. In the case of unavailibility of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. There is no purchase or sales presentation required to participate. A purchase does not increase odds of winning. The prize is not transferable in any way and must be taken by the designated winner and his/her chosen travel companion. The winner and travel companion are responsible for their own passports and travel insurances.

 

7. Additional Terms. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Web site. 

 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

8. Use of Data. Sponsor will be collecting personal data about participants when they enter the Sweepstakes online, in accordance with its privacy policy. Marketing information will be sent only to entrants who have "opted-in" to receive further information from VisitScotland and its affiliates. By participating in the Sweepstakes, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy.
